National Stock Car Racing Commission Statement
On March 13, 2006, the National Stock Car Racing Commission heard and considered the Appeal of MRD Racing. The appeal concerned three penalties issued by NASCAR following opening day inspection on Feb. 22, 2006 for the NASCAR Craftsman Truck Series event at California Speedway.
The infractions concerned Section 12-4-A of the NASCAR Rule Book "Actions detrimental to stock car racing" and Section 12-4-Q "Any determination by NASCAR Officials that the truck, truck parts, components, and/or equipment used in the Event do not conform to NASCAR rules: unapproved carburetor main body modification."
The penalties assessed were:
- Loss of 25 NASCAR Craftsman Truck Series Championship Truck Owner Points for owner David Malcolmson.
- Loss of 25 NASCAR Craftsman Truck Series Championship Driver Points for driver Timothy McCumbee.
- $5,000.00 fine for crew chief Brian Berry
The Appellants acknowledged that the carburetor modifications violated the rules, but appealed the severity of the penalties.
The Commission found that the penalties assessed are consistent with recent penalties for similar infractions in the NASCAR Craftsman Truck Series.
Therefore it is the unanimous decision of the National Stock Car Racing Commission to uphold the original penalties assessed by NASCAR. The Appellants have the right under Section 15 of the Rule Book to appeal this decision to the National Stock Car Racing Commissioner.
